    SPECIAL CONDITIONS



    Here are the lease special conditions of the flat addressed at /İSTANBUL and signed by between ……………………. (Lessor) and …………………………….. (Lessee).


    1. The lessee has rented the premises as residence for her and her family. The lessee cannot use the premises for other purposes than as a residence and can not transfer or sublease to the third parties.

    2. The lessee accepts to pay at the appropriate time the maintenance expenses relating to the property which he/she occupies. These expenses will include the compound fee, heating, telephone, electricity, water and cable TV. The lessee is obliged to pay all these expenses after the beginning date of the contract.

    3. All the major renovations inside the house done by the lessee has to be permitted by the lessor.

    4. Monthly rent is ……………………………………………..After the second rental year (…………………….) If this lease contract extend then the monthly rental amount will be increased due to the TEFE and TάFE rates declared by the government. Rental amounts will be paid monthly in the first five days of the related period to the lessor …………………….. bank account …………………………….. Branch (Branch Code:…………….. No:…………….. If any rental amount will not be paid by the lessee on time then the lessor will have the right to ask whole period rental amounts and it necessitates evacuating the premises by the lessee at the same time.

    5. Contract period is for ………years between …………… to ……………... However the lessor will be inform the lessee with a two months written notice to continue the lease of premises or not. The lessor have the right to extend the lease agreement or not after the second year. .

    6. DIPLOMATIC CLAUSE: Only after the first rental year of the contract (………..) at any time the lessee can leave the flat with a two months written notice before the termination date. During these two months written notice period the lessee has to permit third parties to visit the property with appointment.
    Not generally in a contract but is strongly advisable for your protection.
    7. The premises is left to the lessee in good and working condition ,partly furnished, newly painted, bedrooms and living room floors are polished wooden parquet, basement floors are marble, light fixtures on the ceilings (Look at Inventory List). At the time of evacuation the lessee has to leave the premises newly painted, polished, clean, everything complete and in working condition, except normal wear and tear.

    8. The lessee pays…………………………………deposit amount to the lessor. When he/she leaves the property; If there are no hazard, damages and unpaid invoices and if the property is left in the good condition as mentioned in special term no.7 this deposit amount will be paid back to the lessee by the lessor at latest in one month time. Otherwise these unpaid invoices and expenses will be deducted from the deposit amount. If this amount is not adequate, the rest will be provided by the lessee.
    9. Not obeying the terms of the contract necessitates the cancellation of the contract .The addresses of the lessor and the lessee at the front page of the CONTRACT AGREEMENT are their legal addresses.

    10. İSTANBUL courts are responsible at times of disagreement.

    11. This contract will be valid after the payment of first month rent and deposit amounts total which is ……………. to the lessor latest by the ……………………... Otherwise this lease contract will not be valid and cancelled.
